TERMS AND CONDITIONS: Luumi AB | Effective Date: January 2025

1. ACCEPTANCE OF TERMS

By downloading, accessing, or using the Luumi application and services (hereafter "the App" or "the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service. Luumi AB ("we," "us," "our," or "Company") reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the App. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

2. ELIGIBILITY AND ACCOUNT REGISTRATION

2.1 Age Requirement

You must be at least 18 years old to use Luumi. By using the Service, you represent and warrant that you meet this requirement.

2.2 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to maintain the accuracy of this information. You are responsible for maintaining the confidentiality of your account credentials and password. You agree to accept responsibility for all activities that occur under your account.

2.3 Account Termination

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in illegal activity, or provided false information.

3. USER CONDUCT AND PROHIBITED BEHAVIOR

You agree NOT to:

- Create multiple accounts or use fake identities

- Impersonate another person or misrepresent your identity, age, or intentions

- Harass, threaten, abuse, defame, or intimidate other users

- Send unsolicited sexual content or engage in sexual exploitation

- Share personal information of others without consent

- Engage in any form of discrimination based on protected characteristics

- Use the Service for commercial purposes, advertising, or solicitation

- Attempt to access other users' accounts or bypass security features

- Share or distribute malware, viruses, or harmful code

- Collect, harvest, or use data from the Service without authorization

- Violate any applicable laws or regulations

4. SAFETY AND REPORTING

4.1 Your Responsibility

While we implement safety features, meeting people through dating apps carries inherent risks. You are responsible for your own safety. We recommend meeting in public places, informing a trusted person of your whereabouts, and trusting your instincts.

4.2 Reporting Violations

If you encounter behavior that violates these Terms or makes you feel unsafe, you can report it directly through the App. We take all reports seriously and investigate accordingly.

4.3 Our Response

We will review reports and take appropriate action, which may include warning, suspending, or permanently removing users who violate our policies.

5. CONTENT AND USER-GENERATED MATERIAL

5.1 User Content

Content you create on Luumi (profiles, messages, photos) remains your property. By posting content, you grant Luumi AB a non-exclusive, worldwide, royalty-free license to use, display, and store this content for the purpose of operating the Service.

5.2 Photo Guidelines

You agree that all photos you upload are:

- Of you (or clearly labeled as otherwise)

- Appropriate and not sexually explicit

- Not copyrighted or trademarked material belonging to others

- Not hate speech or discriminatory imagery

We reserve the right to remove photos that violate these guidelines.

5.3 Removal of Content

You may delete your content at any time. Upon account deletion, we will remove your profile and associated data within a reasonable timeframe, except where required by law to retain records.

6. PRIVACY AND DATA PROTECTION

We collect and process personal data in accordance with GDPR and Swedish data protection laws. Please refer to our [Privacy Policy] for detailed information about:

7. COMMUNICATION AND MESSAGES

7.1 In-App Communication Only

We strongly encourage all communication to occur within the App. Sharing contact information (phone, email, social media) is at your own risk. We are not responsible for communication that occurs outside the App.

7.2 Message Deletion

You can delete messages you've sent. Once deleted, messages are no longer visible to you or the recipient.

7.3 No Obligation to Respond

No user is obligated to respond to messages or continue conversations. Respect boundaries and accept rejection gracefully.

8. BLOCKING AND ACCOUNT CONTROLS

8.1 Blocking Users

You can block any user at any time. Blocked users cannot view your profile, message you, or see you in their recommendations.

8.2 Profile Visibility

You can hide your profile, pause your account, or make it private at any time without penalty.

8.3 Account Deletion

You can delete your account at any time. Upon deletion, all your data will be permanently removed from our servers within 30 days, except where retention is required by law.

9. SUBSCRIPTION AND PAYMENT

9.1 Free Service

Basic features of Luumi are provided free of charge. Premium features may be available for purchase.

9.2 Premium Subscriptions

- Subscriptions renew automatically unless canceled

- You will be notified of renewal charges before they occur

- You can cancel anytime through your account settings or by contacting support

- No refunds will be issued for partial subscription periods

9.3 Payment Processing

All payments are processed securely through authorized payment providers. We do not store full credit card information on our servers.

9.4 Billing Issues

If you believe you've been charged in error, contact support within 30 days of the charge.

10. INTELLECTUAL PROPERTY

All content, features, and functionality of Luumi (including but not limited to design, text, graphics, logos, and software) are the exclusive property of Luumi AB and are protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any Luumi content without prior written permission.

11. DISCLAIMERS

11.1 "As-Is" Service

Luumi is provided on an "as-is" basis without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

11.2 No Guarantee of Matches

We do not guarantee that you will find matches, connections, or relationships through the Service.

11.3 Third-Party Content

We are not responsible for content posted by other users. Any interactions or transactions between users occur at their own risk.

11.4 Third-Party Services

Luumi may integrate with third-party services. We are not responsible for their policies, practices, or content.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Luumi AB, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

- Emotional distress or trauma from interactions with other users

- Loss of income or opportunity

- Reputational harm

- Data breaches (except where caused by our gross negligence)

Our total liability to you shall not exceed the amount you paid to use Luumi in the past 12 months, or $100 USD, whichever is less.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Luumi AB, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

- Your violation of these Terms

- Your use of the Service

- Your interactions with other users

- Your violation of any law or third-party rights

14. DISPUTE RESOLUTION

14.1 Informal Resolution

If you have a dispute, please contact us at support@luumi.se. We will make reasonable efforts to resolve the issue.

14.2 Governing Law

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles.

14.3 Jurisdiction

Any legal action or proceeding shall be brought exclusively in the courts located in Stockholm, Sweden, and you consent to the personal jurisdiction and venue of these courts.

15. ACCESSIBILITY AND INCLUSIVITY

16. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Luumi AB regarding your use of the Service and supersede all prior agreements and understandings.
